Housing Minister Grant Shapps has plans to speed up the process for evicting persistent perpetrators of Anti Social Behaviour (ASB)

Mr Shapps intends to introduce a new route to possession for serious housing-related ASB that has already been proven by another court. Possession of the home will be mandatory and it will not be at the discretion of the judge to choose whether to grant the order or not. These will be called trigger offences, for example:

• a conviction for a serious offence related to housing, including violence against neighbours, drug dealing and criminal damage

• breach of an injunction for anti-social behaviour obtained by a landlord

• closing of a premises under a closure order – such as a home used for drug dealing

The consultation paper  Consultation on ASB new power of possession on this new power is open for comments until 27th October. Final proposals based on the responses to this consultation will be published in the autumn by the Home Office.
