Two potentially significant housing cases are being heard in the highest court in England this week.
According to Inside Housing:
The cases, which concern eviction rules and tenant rights, began in the Supreme Court on Monday and a decision on both is expected later this year.
The first case involves Newham and Lewisham councils and looks at whether local authorities can evict households from temporary accommodation without a court order. Both Newham and Lewisham councils have evicted tenants in this way. The case will look at whether temporary accommodation should be considered a ‘dwelling’, which would give residents rights under the Protection from Eviction Act.
The second case, involving Dacorum Council, will examine whether a notice to quit, given to a joint tenant, should be sufficient to end a tenancy.
