New TUPE law guidance has advised employers to undertake extensive consultation and engage with trade unions during business transfers.

According to the CIH:

Documents issued by the Advisory, Conciliation and Arbitration Service (Acas) aim to support employers dealing with TUPE law when their businesses change hands to a new owner.

The Handling TUPE transfers guide includes advice on when TUPE applies, how to correctly approach process and information requirements.

Up to two million employees are thought to be affected by business transfers every year.

‘TUPE is often seen as complicated but employers need to get to grips with the detail if they decide to buy a business or take on work being carried out by others,’ Anne Sharp, Acas chief executive, said.

Acas’ guidance recommends keeping contract information up to date and setting up an employee forum and dedicated management team to run the business transfer.

‘TUPE can affect all businesses and organisations, whatever their size or sector. One of our key messages is that you should involve employees early to minimise concerns and potential problems further down the track,’ Sharp added.
