A woman has been evicted from her Northwards Housing home after her noise became so bad that her neighbours’ children had to wear earmuffs to get to sleep.
Maria Jiminez was evicted from her home on Hollinwood Avenue, Moston, after repeatedly ignoring warnings about her behaviour.
Officers from Northwards Housing were able to secure her eviction after a crucial piece of evidence came to light – a drawing made by a six-year-old girl, who lived near the defendant.
The youngster made the drawing in school describing her new home. It was called ‘New House, gangs and loud music” and had a drawing of the house with a red scribble right through it.
The teacher was so concerned that she raised it with the little girl’s parents, and the drawing was used in evidence in court.
Jiminez, 45, was first taken to court in December 2012 and was issued with an injunction to stop the noise. When it continued, officers started legal proceedings for an eviction. In August this year, Jiminez was handed a suspended possession order, which meant that she could be evicted if the nuisance continued.
Despite repeated warnings, Jiminez was having loud parties, playing music into the early hours of the morning. There was screaming and shouting both inside and outside the property, and was fighting in the street. Children living near the property had to stack pillows against the walls to muffle the noise and wear earmuffs to get a good night’s sleep.
Mike Stevens, director of neighbourhood services, said: “Our teams know that noise nuisance can be a nightmare for the tenants who have to endure it.
“By acting swiftly, we were able to tackle this horrendous anti-social behaviour head on.
“Our quick-thinking officers were able to take legal action by using this heart- breaking drawing as evidence and we are delighted that the courts were able to act to rid this neighbourhood of such a selfish and anti-social character.”
